1. Acceptance of these Terms

1.1 This website and online store are operated by Fresh Feels Co Pty Ltd (Fresh Feels, we, us, our).

1.2 By accessing our website, creating an account, or purchasing from us you agree to be bound by these Terms and Conditions, our Privacy Policy, our Returns and Refunds Policy, our Shipping Policy, and any additional terms that apply to promotions or specific features.

1.3 If you do not agree to these Terms you must stop using the website.

2. Eligibility and Account

2.1 You represent that you are at least the age of majority in your state or territory of residence, or you have consent from your parent or legal guardian.

2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Australian Consumer Law

3.1 Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies available to you under the Australian Consumer Law (ACL).

3.2 Where we are permitted to limit remedies for a failure to comply with a consumer guarantee, our liability is limited to the replacement of the goods, the supply of equivalent goods, or the payment of the cost of replacing the goods or acquiring equivalent goods.

4. Product Information and Availability

4.1 We sell household cleaning products including cleaning sheets. Product images and descriptions are provided for general information. Minor variations may occur due to manufacturing or display settings.

4.2 We may limit quantities, discontinue products, or refuse orders where lawful to do so.

4.3 All prices are in Australian dollars (AUD) and include GST where applicable.

5. Orders, Pricing and Payment

5.1 An order is an offer to purchase and is subject to our acceptance. We may cancel or refuse an order where lawful to do so including for suspected fraud, error in pricing or stock, or breach of these Terms.

5.2 You must provide accurate billing, delivery, and contact details.

5.3 We will charge the payment method at checkout. If payment fails, the order will not be processed.

5.4 We try to ensure pricing is accurate. If there is an obvious pricing error we may cancel the order and process a refund.

6. Shipping and Delivery

6.1 Territory: We ship within Australia only.

6.2 Free Shipping Threshold: Free standard shipping applies to orders with a merchandise subtotal of $60.00 AUD or more after discounts and before shipping fees. Free shipping does not apply to express services.

6.3 Dispatch and Timeframes: Indicative dispatch and delivery timeframes are shown at checkout and in our Shipping Policy. Timeframes are estimates and may vary due to carrier capacity, public holidays, or events outside our control.

6.4 Delivery Address and Authority to Leave: You are responsible for providing an accurate and secure delivery address. Where you or the carrier authorise unattended delivery, risk of loss passes on delivery to the specified location.

6.5 Risk and Title: Title passes when we receive full payment. Risk passes on delivery.

6.6 Return to Sender (RTS): We do not operate an RTS service. If a parcel is returned to us due to incorrect address, refusal, or failure to collect, we may cancel and refund the order less the original shipping cost once the parcel is received, or allow you to place a new order. We do not automatically re-ship returned parcels.

7. Returns and Refunds

7.1 Your rights under the ACL apply in addition to any policies we offer. If a product has a major failure you are entitled to a replacement or refund. If the failure is minor you are entitled to a repair or replacement within a reasonable time.

7.2 Change of Mind: For hygiene and safety reasons, we accept change-of-mind returns for unopened, unused products in original packaging within 30 days of delivery. You are responsible for return postage. Refunds exclude original shipping fees and will be processed to the original payment method once the items are received and inspected. This policy does not limit your ACL rights.

7.3 How to Lodge: Please contact us at support@freshfeels.com.au or via the website form with your order number and details. Do not return goods without first contacting us.

8. Promotions, Discount Codes and Credits

8.1 From time to time we run promotions, discount codes, gifts with purchase, or other offers. Each promotion is subject to Promotion Terms and Conditions available on our Promotions page and any terms stated in the promotional materials.

8.2 Promotions apply only during the stated period, are not transferable or redeemable for cash, and cannot be combined with other offers unless stated.

8.3 Unless stated otherwise, promotions do not apply to shipping charges, gift cards, or bundles.

8.4 We may vary or withdraw a promotion where lawful, for example if fraud or system error is detected, provided this does not affect your rights in respect of orders already placed in reliance on the promotion.

8.5 We do not offer student discounts or a referral program. We do not offer pre-sale or instant exchange programs.

9. Gift Cards and Store Credit

9.1 Where offered, digital gift cards and store credits are valid only for purchases on our website, are non-refundable, and cannot be redeemed for cash except as required by law. Expiry and balance details will be disclosed at the time of issue and comply with Australian gift card laws.

10. User Content and Reviews

10.1 If you submit reviews, feedback, images, or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce, and display that content in connection with our business.

10.2 You warrant you own or control the rights to your content and that it does not infringe any third-party rights, contain unlawful material, or malware. We may moderate or remove content at our discretion.

11. Acceptable Use

11.1 You must not use the website for unlawful purposes, to violate privacy or intellectual property rights, to transmit malware, to scrape or harvest data, or to interfere with the security or operation of the website.

12. Third-Party Services and Links

12.1 We may provide access to third-party tools, apps, payment gateways, or websites. We are not responsible for third-party content or terms. Your use of third-party services is at your own risk and is governed by their terms and privacy policies.

13. Intellectual Property

13.1 All trademarks, logos, product names, text, graphics, and other content on the website are owned by or licensed to Fresh Feels. No rights in our intellectual property are granted to you except as necessary to use the website for its intended purpose.

14. Warranties and Liability

14.1 Except as required by the ACL or other non-excludable law, the website and services are provided on an “as is” and “as available” basis and we do not make warranties about uninterrupted or error-free access.

14.2 To the extent permitted by law, our liability for non-excludable obligations is limited to the remedies stated in clause 3.2.

14.3 We are not liable for indirect or consequential loss, loss of profits, or loss of data arising from your use of the website or purchase of products, except where we cannot exclude or limit liability under the ACL.

15. Privacy

15.1 We handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy, which forms part of these Terms. Please review the Privacy Policy for details about how we collect, use, and disclose personal information.

16. Communications

16.1 By providing your email address you agree we may send you transactional emails about your orders and account. Marketing emails will be sent only in accordance with consent and applicable laws. You can unsubscribe from marketing at any time.

17. Suspensions and Termination

17.1 We may suspend or terminate your access to the website where lawful to do so, including for breach of these Terms or suspected fraud. Termination does not affect accrued rights.

18. Changes to the Website and these Terms

18.1 We may update the website and these Terms from time to time. The version posted on the website at the time you place an order will apply to that order. We will use reasonable efforts to highlight material changes. Continued use of the website after changes take effect constitutes acceptance.

19. Force Majeure

19.1 We are not liable for delay or failure to perform due to events beyond our reasonable control including natural disasters, pandemics, labour disputes, utility failures, or carrier disruptions.

20. Governing Law and Jurisdiction

20.1 These Terms are governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland and the courts entitled to hear appeals from them.

21. Severability

21.1 If any provision of these Terms is held invalid, illegal, or unenforceable, that provision is severed and the remaining provisions continue in full force.

22. Entire Agreement and No Waiver

22.1 These Terms, together with policies and any Promotion Terms, form the entire agreement between you and us in relation to the website and sale of products.

22.2 No failure or delay by us in exercising a right under these Terms operates as a waiver of that right.
